    Is the duty to manage the same across care homes and sheltered housing?

    No. In care homes, the duty to manage usually falls on the provider running the home or the freeholder under the lease (e.g. the operator or landlord). 

    But sheltered housing works slightly differently. If the care home is an individual flat building let on a tenancy agreement, the Control of Asbestos Regulations (2012) only applies to the non-domestic/communal areas of the premises.
